ABSTRACT

This communication represents a novel approach of the axiological system which substantiates the rules of actual education. Because in the field of our investigation is entering a number of issues regarding the process of education, the educational ideal, the formal and informal values, the educational capital etc., we consider necessary an inter and transdisciplinary approach of the topic discussed. So, in order to illustrate the universality and, also, the specificity of the values and rules which ground and order the education today, we are calling both the science of law and the sciences of education, and, also, the approaches specific to sociology, anthropology, history, philosophy of values. The novelty of investigation can be synthesized on two coordinates:
a)the demonstration of the moral ambivalence of the identity, by working thelegal principles of the action in time, space and on persons of the rules;
b)highlighting the consequences of the fertile negative contamination byimitation in the actual education.
