ASSESSMENT OF PROCEDURES FOR DETERMINING PROPERTY BOUNDARIES IN THE CONTEXT OF CREATING CADASTRE IN POLAND

ABSTRACT

Historical conditions determine the functioning of two systems of recording real estate data in Poland. These include land and mortgage registers, which disclose the legal status of a property, and the records of land and buildings, which collect data on the structure and surface area. Since 1996 in Poland, efforts have been made to synchronize these two systems in order to create a unified real estate cadastre. From the property owner’s point of view, one of the most important issues is a clear and correct definition of the ownership rights in the cadastre. The article presents the legal basis, the rules and procedures for determining the boundaries of properties. A critical analysis of these procedures was carried out. The possibilities of using the resulting data to support the created real estate cadastre were evaluated.
